    CHILDREN'S DATA

    The Services are not intended to be used by children, and we do not knowingly collect any personal information about children.     INTERNATIONAL USERS

    Please note that we may transfer, store and process your personal information outside the country you live in, including the United States. Your personal information is also processed by staff and third party service providers and partners in these countries.

    If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

    TIKTOK

    We use TikTok Pixel, a tracking technology that collects & shares customers' browsing behavior on our store. Browser-based ad blockers can prevent this pixel from collection data. The pixel will automatically capture and transmit privacy-safe webpage information as visitors interact with the website. TikTok will honor users' in-app and device-level privacy settings.     PINTEREST

    We use the Pinterest Tag to send Ad Data that helps them measure ad effectiveness, ad delivery and reporting, improve safety and security on Pinterest, research and product development. These measurements will not identify us or any of our customers. Pinterest will use appropriate technical and organizational measures to protect the security and confidentiality of Ad Data we give them, and will comply with the Pinterest Privacy Policy located at policy.pinterest.com/privacy-policy  (or a successor URL) in connection with their use of Ad Data. Pinterest will not share Ad Data we give them with a third party (except affiliates, contractors and agents subject to confidentiality obligations) unless required by law or with your permission.

    TEXT MARKETING TERMS AND CONDITIONS

    We are using a text messaging platform, which is subject to the following terms and conditions. By opting in for our text marketing and notifications, you agree to these terms and conditions.

    By entering your phone number in the checkout and initializing a purchase, subscribing via our subscription form or a keyword, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. You acknowledge that consent is not a condition for any purchase.

    Your phone number, name, and purchase information will be shared with our SMS platform "Klaviyo", which has offices in the United States, United Kingdom, and Australia. This data will be used for sending you targeted marketing messages and notifications. Upon sending the text messages, your phone number will be passed to a text messages operator to fulfill their delivery. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

    If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. Message and data rates may apply.

    CALIFORNIA ONLINE PRIVACY PROTECTION ACT

    CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy.     Request Verification

    Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system.     VIRGINIA PRIVACY NOTICE (VCDPA)

    Under the Virginia Consumer Data Protection Act (VCDPA):

    "Consumer" means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context.

    "Personal data" means any information that is linked or reasonably linkable to a an identified or identifiable natural person. "Personal data" does not include de-identified data or publicly available information.

    "Sale of personal data" means the exchange of personal data for monetary consideration.

    If this definition of "consumer" applies to you, we must adhere to certain rights and obligations regarding your personal data.

    If you are using an authorized agent to exercise your rights, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

    Verification process

    We may request that you provide additional information reasonably necessary to verify you and your consumer's request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request.

    Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

    Right to appeal

    If we decline to take action regarding your request, we will inform you of our decision and reasoning behind it. If you wish to appeal our decision, please email us at support@emijay.com. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may file a complaint with the Virginia Attorney General’s Office. 

    COPPA (CHILDREN ONLINE PRIVACY PROTECTION ACT)

    When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

    We do not specifically market to children under the age of 13 years old.

    FAIR INFORMATION PRACTICES

    The Fair Information Practice Principles (FIPPs) form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

    In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

    • We will notify you via email within 1 business day
    • We will notify the users via in-site notification within 1 business day
    We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

    CAN SPAM ACT

    The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

    We collect your email address in order to:

    • Send information, respond to inquiries, and/or other requests or questions
    • Process orders and to send information and updates pertaining to orders.
    • Send you additional information related to your product and/or service
